Leaving does not end your liability
Moving out does not end your share of the mortgage or rent — and voluntarily paying toward the household while excluded is evidence a court notices (it shows you prioritised the children's home). Record every payment: bank reference, date, amount. At the same time, do not quietly fund a home you are barred from entering forever — payments are interim goodwill, and their treatment is settled in the financial remedy process (see Form E preparation).
If you have nowhere to stay tonight
- Council homeless duty Apply to any local council for a homelessness assessment under the Homelessness Reduction Act — fathers with (or expecting) children contact can qualify for help to secure accommodation. Start at the official route: GOV.UK homelessness help.
- Say the right things Tell the council you are "threatened with homelessness" and that a child depends on contact with you — trigger the duty in writing, keep the reference number.
- Charity support Dads House signposts emergency housing and foodbank desks for single fathers, including non-resident dads in crisis.
- Then fix the legal position A bed tonight, then the law: HR1 registration, or an occupation-order application — the court that would hear it is listed on our Macclesfield-area court page.
Rough-night reality check: fathers under-represent themselves to councils out of pride or assumption ("they only help mothers"). The statutory homeless duty is about vulnerability and children's welfare — apply, in writing, and record everything.

Can she change the locks while I'm at work in Macclesfield?
If you are married or a joint owner/tenant — no, not lawfully, and an occupation order can restore access. Will moving out weaken my case for the children?
It can — courts prefer workable contact, and distance complicates it. If you have already left (or were forced), build the record: why you left, every attempt to return or to see the children. A dated log turns a bad week into credible evidence.
Do I still pay the mortgage if I'm barred from the house?
Yes — exclusion doesn't suspend liability, and arrears damage your credit and your standing. Keep paying if you possibly can, document it, and raise the sharing of outgoings in correspondence.
